Town approves new smoking control bylaw

The Town of Battleford approved a smoking control bylaw at its meeting Monday to cover cannabis and tobacco use, as well as vaping using electronic cigarettes.

The bylaw generally prohibits smoking and consuming tobacco products, vaping and using cannabis in enclosed public places. Cannabis use in particular is prohibited in any public place.

“We finally put the smoking bylaw in front of council that was updated to include cannabis and all smoking products,” Mayor Ames Leslie said. “We have a very inclusive smoking bylaw to control all types of smoking within the town of Battleford.”

He said the cannabis policy needed to be written as part of the legislation related to its legalization.

“Administration thought they might as well put out an updated smoking bylaw at the same time and encompass it all into the policy,” Leslie added.

According to the bylaw, medical cannabis users who have been issued a regulation permit are not subject to this bylaw, and must present a copy of their medical order when requested by an officer.

Among some of the highlights of the bylaw, business or establishment owners, such as restaurant owners, are not allowed to permit people to use cannabis on their premises. People are also not allowed to use cannabis in schools or the grounds surrounding schools, or while inside a vehicle.

The bylaw indicates the policy aims to protect residents’ safety, and quality of life, and also to protect property.

There are some provisions in the bylaw. For example, for tobacco, the bylaw doesn’t prohibit its use for a traditional Aboriginal spiritual or cultural practice or ceremony held on town-owned property.

The town’s smoking control bylaw comes into effect the day the federal Cannabis Act comes into force on Oct. 17.
